A question or a problem? Just write me an email. Withdrawal is explained on the Right of Withdrawal page, data on the App Privacy Policy page.
1. What these terms cover
These terms apply to the SevenGrid app and to the website sevengrid.app. The provider is me, Stefan Roßkopf, a sole trader operating as "ByteSide.io", Anemonenweg 7, 89547 Gerstetten, Germany (see Imprint). SevenGrid is built and run by one person; "I" and "me" in these terms always mean me.
2. The app
SevenGrid is a habit tracker. You can use it for free with up to three habits, the last four weeks of history and the full CSV export. Pro is unlocked with a one-time purchase. There is no subscription. If you have bought Pro, Pro features added later are included at no extra cost.
Pro applies to the store you bought it in and can be restored there with the same account. Switching between Android and iPhone needs a separate purchase. Pro unlocked with a code counts as a purchase; the store's code terms also apply.
3. Purchases
You buy Pro in the store you installed SevenGrid from. Who you contract with depends on the store and your store account's country.
Google Play: in the countries where Google is the merchant of record (all EU countries, Iceland, Liechtenstein, Norway, the United Kingdom and a few other territories, see Google's list), Google Commerce Limited sells Pro to you in its own name; payment, refunds and withdrawal then go through Google. If you email me within 14 days of buying, I will still refund the price through Google Play, voluntarily and without asking why. Everywhere else, for example Switzerland or the United States, I am the seller and Google handles payment and refunds. Google Play's terms of service also apply to the purchase.
Apple App Store: in most countries, including all of Europe, Switzerland and the United Kingdom, Apple sells Pro to you in its own name (in Europe: Apple Distribution International Ltd.). In some countries, such as the United States, Canada, Australia, New Zealand, Japan and Latin America, Apple acts only as an agent and I am the seller. Payment and refunds always go through Apple; Apple's Media Services Terms apply to the purchase.
In every case your license to use SevenGrid comes from me: on Android under section 5, for the App Store version under Apple's Licensed Application End User License Agreement. Where these terms give you more rights than Apple's standard agreement, these terms prevail.
How to withdraw from a purchase or get a refund is set out on the Right of Withdrawal page.
4. No account, your data
SevenGrid needs no account. Your entries are stored on your device, not on a server of mine. That also means that if you lose your device or delete the app, I cannot restore your data. On the iPhone your entries are part of your iCloud backup if you have it switched on; on Android they are kept out of the Google device backup. Back them up yourself if you need to, for example with the CSV export in the app. How the app handles data is described in the App Privacy Policy; the website is covered by the Privacy Policy.
5. Your license
You may use SevenGrid for your own purposes, without time limit. Pro is tied to the store account you bought it with. The name, logo, themes and design of the app remain protected (see Imprint). The printable weekly grid without logo, closing line and address line is the exception: it is licensed under CC BY 4.0 and may be shared freely with the credit "SevenGrid, sevengrid.app".
6. Development and updates
I keep developing SevenGrid. I only change features or design where there is a valid reason, such as new requirements from Android, iOS or the stores, security, privacy, bug fixes or clearly better usability, and where the change is reasonable for you. Changes never cost you extra. Pro features you paid for will not be taken away without a replacement.
After you buy Pro, I promise updates for at least 24 months that keep SevenGrid working and secure on current Android and iOS versions. Any statutory rights you have regarding digital products, such as the EU right to updates, are not affected.
7. Not a substitute for advice
SevenGrid helps you keep track of habits. It is not a medical device and does not replace medical, psychological or therapeutic advice.
8. Liability
I am liable without limitation for intentional misconduct and gross negligence, for injury to life, body or health, for defects I fraudulently concealed, to the extent I have given a guarantee, and under the German Product Liability Act. For simple negligence I am only liable if an essential contractual obligation is breached, meaning one whose fulfilment makes the proper performance of the contract possible in the first place and on which you may regularly rely; in that case liability is limited to the typical, foreseeable damage. For loss of data caused by simple negligence I am only liable for the effort that would have been needed to restore it from regular backups, such as the CSV export. These rules also apply to people I am responsible for. Your statutory warranty rights are not affected.
9. Governing law and disputes
These terms are governed by German law. If you are a consumer, you keep the protection of the mandatory laws of the country where you habitually live. The license for the App Store version is instead governed by the law chosen in Apple's standard license agreement.
I am neither willing nor obliged to take part in dispute resolution proceedings before a consumer dispute resolution body. If something is wrong, write to me; that is almost always the faster route.
10. Changes to these terms
New versions of these terms only apply to you once you agree to them; changes that are purely in your favor apply right away. Earlier versions stay available on this page.
11. Language versions
These terms exist in English and in German. If the two versions differ, the German version prevails.
